The call focused on the Comstock Act of 1873, a 150-year-old law that Republicans are trying to resurrect to ban abortion nationwide. While it was frightening to learn all the ways the far right could use this antiquated law to control us, we were also heartened to learn that bills to repeal the Comstock Act have been introduced in the House and Senate, and we are already fighting for their passage.

Anti-abortion extremists are exploiting the Comstock Act, a draconian law from 1873 that bans the U.S. Postal Service and other carriers from mailing materials deemed “obscene.” They are using the law to prohibit the mailing of the abortion pill mifepristone or any drugs, instruments, or supplies for abortion care. While the AI-generated images of Taylor Swift may have been removed, most people don’t have an army of fans who can come to their defense online. Congress can protect all of us from this abuse by passing the DEFIANCE Act, which will create a federal civil remedy for victims who are identifiable in a “digital forgery,” which is defined as a visual depiction created through the use of software, machine learning, artificial intelligence, or any other computer-generated or technological means to falsely appear to be authentic.
